RESOLUTION AWARDING CONTRACT TO ITT FLYGT CORPORATION
FOR THE FURNISHING AND DELIVERY OF
ONE (1) REPLACEMENT PUMP, MOTOR AND APPURTENANCES
(PROPRIETARY GOODS PURSUANT TO N.J.S.A. 40A:11-13 (d))
FOR THE GTMUA’S PIERCE BATTERY PUMP STATION 

R-06-08-73

 

 WHEREAS, the Gloucester Township Municipal Utilities Authority ("GTMUA"/"Authority") requested bids for the furnishing and delivery of one (1) Replacement Pump, Motor and Appurtenances for the Pierce Battery Pump Station (“Replacement Pump”); and
 WHEREAS, the GTMUA publicly advertised for bids and furnished detailed bid specifications to potential bidders which included a written certification from the contracting agent and purchasing agent explaining why the specifications required a proprietary product of a specialized nature that is necessary for the conduct of the affairs of the Authority; and
 WHEREAS, the bids were received and opened at the Administrative Offices of the GTMUA on June 19, 2008; and
 WHEREAS, one (1) company submitted base bids for the specified equipment as follows:

 1. ITT Flygt Corporation      $31,000.00; and
 WHEREAS, the Replacement Pump is specialized in nature and necessary for the conduct of the affairs of the Authority for the following reason:
1. The GTMUA, through its consulting engineer, Joseph T. Brickley, P.E. of CES, (“Brickley”) has identified the need the need for a Replacement Pump to serve the needs of the Authority.
2. Brickley has rendered an opinion that the Pierce Battery Pump Station was originally designed with ITT Flygt pumps, motors and appurtenances, which is the pumping system which was approved, installed and accepted by the Authority and its Engineer, at that time and that the submersible pump system includes but is not limited to: ITT Flygt Pumps; ITT Flygt Motors; ITT Flygt Pump performance monitoring instruments (CAS System); ITT Flygt Pump guide rails and mounting brackets; ITT Flygt Pump base with mating connection.
3. Brickley has further opined that these components were designed to be integral parts of the submersible pump system and directly influence the performance of the overall system.  Furthermore, the pumping system is controlled by a Bihlertech torque vector drive system currently matched to the ITT Flygt pump operating performance.
4. It is the professional opinion of Brickley that replacing the existing ITT Flygt submersible pump system and their components with ITT Flygt replacement parts and components is compelling and advantageous to the Authority and that there is a value gained by the Authority having a spare pumps and parts compatible to the “in place” components in case of an emergency and in the performance of routine maintainance.
5. Authority staff are very familiar with ITT Flygt components and have experience and equipment “in-house” to perform routine maintenance and replacement of ITT Flygt components. The value of the performance integration and the Authority’s experience exceed any benefit which may be obtained through preparing procurement documents allowing substitute or equivalent components in a competative bidding process.
6. The value gained by the Authority and its ratepayers by designating the use of such proprietary equipment, far outweighs the public benefits of permitting brand name or equivalent equipment and/or the benefits traditionally obtained by the open competitive process.      
 WHEREAS, ITT Flygt Corporation complied with all the essential provisions of the bid specifications; and
 WHEREAS, ITT Flygt Corporation is the lowest qualified bidder; and
 WHEREAS, there are funds are available for the purchase of the equipment.
 THEREFORE, BE IT RESOLVED, by the Gloucester Township Municipal Utilities Authority, a body corporate and politic, as follows:

 1. The provisions of the WHEREAS clauses set forth above are incorporated herein by reference and made a part hereof.

 2. The GTMUA specifically finds that the proprietary designation set forth in the bid specifications is of such a compelling nature that the value to the public that is gained by the proprietary designation overshadows and outweighs the public benefit of permitting “brand name or equivalent” and the benefits of such competition.

 3. Contract for the Flygt Pump for the Pierce Battery Pump Station in the amount of $31,000.00 is hereby awarded to ITT Flygt Corporation.
 
 BE IT FURTHER RESOLVED, that funds are available for payment of this Contract.
